CIVIL LITIGATION

Civil litigation involves the process by which legal disputes are resolved, whether by settlement, mediation, arbitration or trial. Our civil litigation expertise includes primarily real estate litigation (contract disputes, broker disputes, nondisclosure, business disputes) and construction defects litigation. Civil litigation is not, as some believe, a broad area covering all aspects of the law, but is a specialized field within the practice of the law. After initially representing builders and developers, members of the firm began representing homeowners' associations in defects suits against builders and developers in the early 1980s. The firm is presently among a handful of recognized law firms in the Bay Area who specialize in the prosecution of construction defects suits on behalf of homeowners' associations, owners, and investors in real estate.

The firm has successfully litigated all manner of civil disputes in areas including construction defects, real estate fraud and nondisclosure, partnership disputes, land use and development, commercial and real estate litigation, environmental law, eminent domain and inverse condemnation, insurance coverage, government claims, and professional malpractice.

We believe that our opponents recognize our litigation abilities, thus enhancing the potential for prompt resolution of disputes. Of course, in those instances where a favorable settlement is not available, we have the experience necessary to efficiently and effectively manage litigation through trial and on appeal.
