Sloan C. Bailey
Partner

Sloan Bailey is a trial lawyer, whose practice includes construction and complex business litigation. He has been involved in projects including commercial, construction and insurance litigation, contractor delay and impact claims, as well as general counseling and advice on contract negotiations and construction disputes.

Sloan has extensive experience in construction litigation ranging from disputes concerning bid protests, lien disputes, contract breaches, defective work, defective design, changed conditions, worksite catastrophes, stop notices, and late or deficient payment disputes.

In addition, Sloan has served as trial counsel and acting litigation counsel for parties to bench and jury trials, administrative proceedings, arbitrations, and mediations in state and federal courts.

Recently in 2010, Sloan successfully defended an antitrust action in the United States District Court for Northern California. The plaintiffs in this two-month jury trial were seeking tens of millions of dollars in damages, as well punitive damages, based on allegations of attempted monopoly in the context of contracting on public works projects. In 2011, Sloan won a three-week jury trial in state court on behalf of a subcontractor seeking damages for delay and impact to its work.

Sloan has spoken extensively on construction law and practice, including: insurance, indemnity, warranties, retainage, and construction contracts generally. In December 2011 Sloan made a presentation on the topic of prequalification requirements on public works projects at the Construction Superconference in San Francisco.

He is a Settlement Conference Panelist & Arbitrator for Marin County Superior Court; Planning Commissioner for the Town of Corte Madera; and General Counsel for the Flooring Contractors Association (FCICA).
